TERMS OF SALE 

 

Hereunder are the General Terms and Conditions applicable for the Sale of Philippe Petra products via philippepetra.com, hereafter referred to as the ‘Website’.

 

Hestia Consulting Limited (HK) (hereafter referred to as ‘HCL’) sells products covered by the ‘PHILIPPE PETRA’ trademark/brand in Hong Kong SAR.

 

To ensure the efficient and timely service of our Customers, HCL has created a distance sales network for certain of our products via the Website. 

 

These General Terms and Conditions of Sale are applicable to all distance sales of Philippe Petra products via the Website, which are regulated exclusively under the  applicable Hong Kong SAR law.

 

The use of the distance sales service as described herein is reserved solely to Philippe Petra Customers. The term ‘Customer’ is to be understood as any physical person making purchases for purposes unrelated to their business, commercial, artisanal or professional activity. The resale, rental or transfer for commercial or professional use of products purchased on the Website is strictly forbidden and punishable by law.

 

HCL reserves to right to modify its General Terms and Conditions of Sale from time to time as it may see fit and according to the applicable laws and regulations. Therefore, to ensure proper information dissemination and Customer awareness, the Customer is asked to accept the General Terms and Conditions of Sale in force at the time of purchase, each time one takes such action. Therefore, any Customer proceeding to a purchase, will be asked to accept the present Terms and Conditions of Sale by clicking the relevant boxes, which form an integral and substantial part of these procedures. You may find such Terms and Conditions of Sale at any time on the Website, without necessarily proceeding to a purchase, should you want to be informed prior to proceeding to a purchase. 

It is noted that, these General Terms and Conditions of Sale do not govern the provision of services, or the sale of products by subjects (third parties) other than HCL, therefore not being applicable to such third parties, even in cases where these are presented on the Official website via links, banners or other hypertext links. Therefore, before placing an order and/or purchasing products and services from third parties, although authorized,  the Customer is invited to check the conditions of sale applied to each one of those parties, as terms and conditions may also defer among them. In no case can HCL be held liable for the provision of services by third parties.

 

For the purposes of these General Terms and Conditions of Sale, the vendor is Hestia Consulting Limited (HK) private company limited by shares, with registered office at Suite 903, 9/F, 20 Luard Road, Wanchai, Hong Kong SAR.

 

1. Product orders

Orders may be placed directly by persons of legal age who have not been declared legally disabled, in  English and via the Website on a 24/7 basis.

 

A valid e-mail address is required from The Customer in order to receive any information concerning the order.

 

It is noted that, for  distance sale orders made covered by these General Terms and Conditions of Sale, each order may be for one or more products, up to a maximum of 6 products per order, of which a maximum of 2 pieces can be of the same article. HCL  reserves the right to modify, from time to time, the  quantity limits and/or types of products that may be purchased via distance sales. 

 

Upon proceeding to a purchase, the Customer is able to see, in their  shopping cart.  the order summary which provides a description of the product(s) ordered, including measurements and sizes (where applicable), the total price of the order including the applicable shipping costs and a digital photograph representing the products available on the Website.  As mentioned in the Section PRODUCT PHOTOGRAPHY & PRODUCT DESCRIPTION, all necessary steps and efforts are taken and made to display as accurately as possible the appearance, and particularly the colours, finish and textures, of our products included on the Website. However, the displayed colour, finish and textures largely depend on your computer settings and, therefore, no guarantee can be provided as to the percentage of correctness of the displayed images in comparison to the actual product.  Size differences from image to actual product may also result from screen resolutions and settings. Therefore, some items may appear slightly larger or smaller than actual size due to screen as well as photography techniques. In addition, to provide a better description of products to Customers, some items may be represented at a larger than actual size in order to clearly show details, or smaller than actual size in order to show the entire item. 

 

Therefore, based on the above, HCL cannot be held liable in such cases for the slight differences which may occur from photography to actual product, upon delivery to the Customer.

Before proceeding to payment and exit, the Customer may click on the shopping cart icon to view the selected article(s) and their total price, including shipping costs. To ensure the Customer is proceeding to the purchase of their selected items only, the Customer is asked to verify the content of the shopping cart before completing the purchase form, in accordance with the instructions provided on the Website, and to confirm that a payment shall be as well as to ensure Customer information and agreement of the  General Terms and Conditions of Sale and Terms of Use.

 

Modifications to the purchase, such as in quantity or to are or remove an article or more by following the instructions provided on the Website, prior to the final payment of the purchase. It is noted that, following purchase, should a Customer wish to return any product which they mistakenly ordered, they should follow the procedure stated in Section SHIPPING & RETURNS.

 

2. Product prices

Unless otherwise stated on the Website, your order summary and/or product page, all product prices include all taxes and duties.

 

All prices are  displayed on each product prior to completion of the order in US dollars and include the applicable VAT, unless otherwise stated on the Website, your order summary and/or product page.

 

As previously mentioned, the total price for your purchase, shown in your shopping cart, includes the  applicable shipping costs , and are clearly stated in the third step of the checkout called ‘Check your order’. 

 

3. Completing the order

To complete an order, a Customer must confirm and submit, upon which action, the HCL team will receive such confirmation.  The customer will then receive a thank you message confirming and validating the order.

 

It is noted that to cancel an order, a Customer can do so by just exiting the Website before confirmation, in which case the order will be automatically cancelled, without any further steps needed. on their behalf.

 

General Terms and Conditions, as well as Terms of Use and the applicable PPOB Privacy Policy, are considered read and unconditionally agreed upon, once the order has been sent, whereby the Customer is considered informed of the obligations instilled upon them through the purchase they have executed. . It is noted that, before proceeding with the purchase of Philippe Petra products, it is recommended to carefully read the aforementioned documents, which are available on the Website via links and which are always available for download and printing.   The Customer can print and save or reproduce this document for their personal use; moreover, the General Terms and Conditions of Sale are always available via the ‘Policies’ section on the bottom right side of the Website. 

 

Upon completion of the order process and receipt of the confirmation email, to the Customer’s email address, the order is considered completed and binding.  Once the product has been shipped, the Customer receives an additional email which provides the information relevant to the shipping, including the tracking number which they can use to track the progress of the shipment and contact the courier service to receive further information.  However, it is noted that, the purchase agreement between HCL and the Customer is concluded upon receipt of the email confirmation for the purchase and not upon receipt of the product.

 

HCL reserves the discretionary  right to accept or reject incomplete or incorrect orders, as well as decide upon cases where the selected products are unavailable or the Customer is not a ‘physical person’. Should HCL choose to exercise such discretionary right, then the Customer will be informed within two (2) business days of submission of the order, and such order will not be executed. It is noted that the reasons for such exercise will be stated in the informative email the Customer will receive. . Any amounts already paid by the Customer for the order will be fully reimbursed. The Customer will receive an email at the provided address which will include the return number and date of purchase, the product(s) ordered, the prices of products and shipping, and the total amount to be reimbursed.

 

 

4. Conditions of payment

 

For the Customer’s easier conduct, several payment methods are available for the purchase of products, which the Customers are invited to use for an order to be valid. 

 

Specifically, these are:

  • Credit Cards

  • PayPal

  • AliPay

 

 

For payments executed via credit card, other type of card or PayPal, the transaction will be charged to the Customer’s card once the order has been accepted and no discretionary right has been exercised by HCL. In such cases, the Customer will receive a confirmation email to the provided  email address.

 

HCL takes all necessary steps to prevent internet fraud and therefore, payments made via the Website, are managed online by the relevant bank using specialised tools. PPOB uses industry-standard Secure Sockets Layer (SSL) encryption where all payment details for the purchased executed on the Website, are collected. SSL protects the confidentiality of credit card information while it is transmitted over the internet to secure the payment for the desired purchase. As part of the actions taken to reduce the risk of fraud and to protect the provided data,  credit card information is never stored on the Website, and therefore, for each purchase, Customers are asked to re-enter their data for each transaction.

 

For payment to be completed, the Customer must confirm on the Website that they are the card holder and that the name indicated on the credit card is theirs. In addition, the Customer is asked to provide the credit card number, expiry date and security code indicated on the card followed by any other additional verification information that may be requested by their bank. It is noted that, upon completing the order, the Customer's bank may request confirmation of the data entered and that the credit card used has not been reported lost or stolen. 

 

No amount is debited from the provided card until the order has been completed and a confirmation email has been sent confirming successful payment. No extra costs are applied/ for credit card payments.

 

If, for any reason, the amounts due by the Customer cannot be debited, the sale process and sale are automatically cancelled.

 

5. Delivery

 

Following order transmission via the Philippe Petra Website, the Customer can monitor delivery of the order in ‘My Profile’ section of the Website by signing in and choosing the option ‘Orders’. If the customer is already signed in she/ he may simply click on his username on the top right portion of the website and then choose the option ‘Orders’.

 

The Customer can contact our Customer Care Service by live chat, or e-mail to request information on the delivery. 

 

Without prejudice to the exceptions below, Philippe Petra can deliver products  only to the address indicated by the Customer in the following countries: 

 

Austria , Belgium, Cyprus, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Netherlands, Norway, Malta, Monaco, Poland, Portugal, Spain, Sweden, Switzerland, United Kingdom, Russia, Turkey, Canada, United States, Argentina, Brazil, Chile, Mexico, China, Hong Kong, Japan, Kazakstan, Korea, Taiwan, Israel, Qatar, Saudi Arabia, United Arab Emirates, Australia, New Zealand, Algeria, Botswana, Egypt, Kenya, Morocco, Nigeria, South Africa, Tunisia (together the ‘Territory’)

No shipping address (or delivery request) will be accepted outside the Territory.

 

The Customer may request delivery to the physical person of her/his choice (whether it is herself/ himself or a third party), whose residence or domicile is within the aforementioned jurisdictions. It is noted that no deliveries are made to P.O. boxes or collection points.

 

The products purchased online are delivered to the address indicated by the Customer only once the payment of the order has been registered, except where philippepetra.com informs the Customer of non-acceptance of the order pursuant to Article 3 above.

 

For security reasons, all Philippe Petra online purchases require the signature of the Customer, or their legal representative in case the Customer is a minor aged under 18, as per applicable laws, upon delivery. All orders are delivered by courier, which will proceed to making a total of two (2) attempts for delivery, should no individual (customer or authorized representative) be available or reached during first attempt. Following these two additional attempts, should there still be no one available to sign for the package, after 5 days with no communication, the package will be returned to the sender.

 

The Website should automatically recognise the Country from which you are connecting. Orders made from a Country different from the one you a customer shipping to, or to addresses to which our courier cannot ship to (P.O. Boxes or General Delivery addresses), will be automatically cancelled.  Saved Items will not be cancelled if the customer proceeds to a change of delivery location, but prices and services will be updated accordingly (prices of items are dependent on delivery country as different countries have different tariffs and customs duties regulations).

 

All orders are delivered by courier. To enable fast and secure deliveries, and in order to meet customers' needs and expectations only Express delivery is used, and as such, the shipping costs for such orders will be charged to the Customer (this is also variable dependent upon the delivery country).

 

All shipping costs, including additional costs charged to the Customer are itemized in the order form at the time of purchase on the Website. Return shipping costs are refunded in the case of returns within 15 days, and as far as no damage is made to the products.

 

All orders are processed Monday through Friday, excluding weekends and bank holidays (Hong Kong SAR).

 

At this time, we can only ship to one address per order. To ship to multiple addresses, please place a separate order for each location.

 

It is noted that all orders are subject to verifications, in particular the billing and shipping addresses and the means of payment. If required, HCL reserves the right to request additional identification information. Such verifications can extend the delivery time for up to two (2) additional business days from those quoted in the order confirmation (dependent upon how fast we can retrieve the additional information from the customer). 

 

Furthermore, it is noted that due to the limited number of production for the Philippe Petra products, delivery may be delayed depending on order verification and products’ availability.

 

HCL is not responsible for any unexpected delays occurring during the shipment by courier.

 

The confirmation e-mail sent to the Customer will contain a tracking code and an exclusive link to track the shipment in real time. Our Customer Care Service can provide assistance for any delivery problems.

 

The Customer is responsible for any loss or damage to the products ordered, for which HCL is not responsible, starting from the time at which the Customer or an authorised third party (other than the carrier appointed by HCL) takes material possession of the products. It is therefore strongly advised that the customer checks that all products received reflect what was ordered and that the products delivered are not damaged or not as described. 

 

Should the Customer make a claim for loss, non-compliance or damage to the product and should HCL agree that the products received by the Customer do not reflect what was ordered or they are damaged or not as described,  the Customer will receive a refund (in full, including all delivery costs), upon express Customer request, according to the terms and conditions described below.

 

philippe-petra.com only provides refunds or e-store crediting, and does note proceed with exchanges at this time.

 

Damaged goods being returned must be in the condition in which the Customer received them; the Customer must not mishandle them or attempt to modify or repair them. 

 

The delivery terms may vary due circumstances not attributable to HCL.

 

6. Returns and Refunds – Withdrawal

 

In cases where a Customer wishes to return a product or receive a refund and exercise the right of withdrawal, the Customer is invited do so as described below.

 

It is noted that, the right of withdrawal may be exercised by a Customer without any motivation, but must be done within 7 (seven) calendar days of the date of delivery to the Customer or a third party, following the returns procedure as set below.

 

 

Step 1: Prepare the package to be returned

Place the items you wish to return in the original packaging (box, accessories, inserts, leaflets, etc.), in which you received them accompanied by the purchase receipt.

 

Step 2: Print return form

Print the return form (form PPR01). 

Carefully complete  return form  and place it in the original packaging of the items to be returned.

 

 

Step 3: Courier pick-up or drop off

Contact and book a pick-up with courier or alternatively, drop off the package at your nearest courier/post office location within 7 days of the original order delivery. Provide the courier/ post office staff the original order box along with the return form.

 

Step 4: Notify our customer care

To notify our customer care staff of your return , email us at philippe.petra@hestiaconsulting.net , attaching to your email a copy of the courier/ postal service receipt and tracking number.

 

For the return to be accepted by us, kindly note the following: 

 

  • Products returned must not have been damaged, used, broken, chipped, oxidised, worn or washed, but may be handled and inspected to determine their nature and characteristics. 

  • Labels must still be attached to the products.In cases where items are returned due to defects, such damaged goods must be in the condition in which the Customer received them. Should the Customer  attempt to modify, handle or repair them, the fulfilment of the refund request will not be possible. Such damages include, but are not limited to, the polishing of gemstone beads is damaged, the gold plating (or silver plating) came off, stones fell out the setting, stones are cracked or broken, the elastic is broken, the packaging is stained etc 

  • HCL reserves  the right,  to not fulfil return and refund requests for products that have been damaged, are incomplete, deteriorated and/or soiled or in any state clearly indicating its use prior to return. Any returns made following the elapse of the deadline for return as set in the present clause (7 days) or lacking a return form will not be accepted.

 

It is also understood that, HCL  reserves the right to seek damages  for any damage caused to the returned item(s) as a result of the Customer's negligent conduct or misconduct. HCL cannot be held liable and bears no responsibility  for lost or stolen products resulting from actions beyond its control and from third parties, or for returns to the wrong address, or for delivery delays of returned products. It is, therefore, understood that the Customer is also responsible for providing proof of return and assumes all risks of returns.

 

In the event of withdrawal, all payments made to HCL via PPOB will be fully refunded to the Customer, and made according to the method of payment used for the purchase of the product(s) for which withdrawal has been exercised, including standard delivery costs. 

 

For returns, the hiring of courier/ postal service for the delivery of the returned item(s) and any costs occurring, will be  at your expense and no liability will be assumed by HCL lost or damaged returns.

 

The refund will be issued, following acceptance of the return, directly to the Credit/Debit Card or PayPal account used for the original purchase and in the same currency. Refunds are at no charge to the Customer (except return shipping cost).

 

7. Limitation of liability

 

Hestia Consulting Limited (HCL) will not be held liable for any direct or indirect damage caused to its Customer from the of products offered for sale on PPOB, excluding cases of defective products, wilful default or gross negligence. HCL liability, in cases of non-fulfilment of its obligations under the purchase agreement r, will be limited to damages equal to the price paid by the Customer for the relevant purchased product(s).

 

8. Product authenticity and intellectual property rights (IPR)

 

The authenticity and quality of all the products sold in the present online store is guaranteed by the PPOB brand.

 

It is noted that all rights are reserved to HESTIA CONSULTING LIMITED (HK), with registered office at Suite B, 7/F, 18 Luard Road, Wanchai, Hong Kong SAR,  and that all intellectual property occurring within the present online store is and shall remain its exclusive property. Such intellectual property includes but is not limited to,  the PHILIPPE PETRA trademark, all the figurative and non-figurative marks and in general all other marks, illustrations, images, logos and designs present on the website, products, accessories and/or packaging, whether registered or not. ,. It is, therefore, understood that any partial or entire reproduction, modification or use of said trademarks, illustrations, images logos and designs is strictly forbidden without the prior express approval of HCL. It is also understood that, Any combination of the afore mentioned materials with other marks, symbols, logos or any distinctive sign suitable for creating a composite logo, as well as the reproduction in whole or in part, modification or use of HCL drawings, models or patents is also forbidden. 

Failure to comply with the present term will result in legal action against the breaching party.

9. Force majeure

 

HESTIA CONSULTING LIMITED (HK) and PPOB will not be responsible for any failure or delay in performance due to circumstances beyond their reasonable control, including, but without limitation, acts of God, war, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, service outages resulting from equipment / software / telecommunication / power / network / third party service providers failures. 

 

Customers affected by said unforeseeable circumstances or force majeure will be informed within seven (7) business days of its occurrence. Should the suspension of the services last more than 15 days, the Customer is eligible to cancel the order and receive a refund of all amounts already paid, as in article 6 hereof.

All Customers can obtain information relevant to the procedures used by PPOB for the processing of their personal data through our Privacy Policy

 

11. Competent jurisdiction and applicable law

 

The present terms of sale relating to philippe-petra.com online store together with all our policies and procedures are governed by and construed in accordance with the laws of Hong Kong Special Administrative Region of the People’s Republic of China. By entering the present online store and using the provided service, it is understood and agreed  that the courts of Hong Kong Special Administrative region shall have exclusive jurisdiction in relation to any claim or dispute concerning or arising from these terms. It is noted that, the Vienna Convention on the International Sale of Goods of 1980 does not apply. 

 

This Site has been designed to comply with the laws of Hong Kong SAR and shall apply as such without prejudice regardless of the region from which a customer may be accessing the online store. We would also like to inform you that any wrongful use of the present website, that is contrary to the applicable laws, as well as the present terms and conditions will not be accepted and may result in legal action. PPOB bears no responsibility with regards to information relevant to the  laws of your jurisdiction a customer is operating from and therefore, information and compliance to those, is the sole responsibility of the latter. 

 

13. Special Terms and Conditions of sale for ‘PRE-ORDER’ products

 

PPOB offers its clients the opportunity to Pre-Order items that are currently in production, made-to-order or that are no longer available and coming back in stock. 

By clicking on  the ‘Pre-Order’ button and completing the required fields, you will be placed on a priority waiting list for the pre-ordered item. Once the item is available and ready to shipped to your indicated address,  you will receive a notification via email informing you of the matter. It is noted that, you will only be charged once your item is ready to be shipped from our logistics center. Furthermore, following the Philippe Petra philosophy of providing excellent services, our Customer Care will take the necessary steps to check whether the item you have pre-ordered is available immediately in our warehouse and could be redirected to the E-Commerce availability for your purchase. 

This procedure does not grant you any booking rights with regard to any relevant product.

The diamonds and metals used in the creation of our pieces come directly from mines , reputable dealers as well as from recycled sources which, to the best of our knowledge, comply with the highest ethical standards of mining practices. Furthermore, the company individually screens its suppliers, thus ensuring that the codes of conduct are  in line with one another. Understanding the social, economic and environmental impacts of the mining and processing of precious materials is one of the company’s main priorities, in order to create a positive impact along the supply chain, all the way from the mine to Customers.

 

2. Conflict-free Diamonds

At Philippe Petra, complete integrity is a value highly appreciated and which is kept throughout its process of production, servicing and delivery, including with regards to the diamonds and materials used, all the while ensuring the highest quality. Therefore, to ensure the diamonds used on Philippe Petra products are conflict free, they are only sourced from countries that are full participants in the Kimberley Process (KP) Certification Scheme.

Through measures such as the KP, which tracks diamonds from mine to market, the diamond industry in partnership with Governments, the United Nations and NGOs controls diamond exports to avoid trade of illegal diamonds.

 

PPOB, wanting to further ensure that such illegal trades are avoided, takes additional steps to the KP. Specifically, PPOB has set a careful chain of custody controls and advocates for stronger global standards with the aim of ensuring that human rights and the environment are protected. In addition, the company is a strong supporter of local communities in which it operates and does so by  hiring locally, providing robust job training and ensuring fair wage practices at its cutting and polishing facilities.
